As expected, the Department of Defense Appropriations Act of 2010, one stipulation of which is to extend the ARRA COBRA Subsidy, was signed into law by President Obama this morning. This Act extends COBRA eligibility from the current deadline of Dec. 31st, 2009 until Feb. 28th, 2010, and also extends the number of subsidized months from 9 to 15 months.

The Department of Defense Appropriations Act of 2010, which holds an extension of the ARRA COBRA Subsidy, has been passed by the Senate and was awaiting signature as of 4:30 EST. The act extends eligibility from the current deadline of Dec. 31, 2009 until Feb. 28, 2010, and also extends the number of subsidized months from 9 to 15 months. Given the fact that much of the act pertains to funding day-to-day defense operations, it is expected that the President will sign the bill with haste.

The House approved legislation to extend the federal subsidy for those receiving benefits under COBRA. The extension was added as a resolution attached to HR 3326 for the Department of Defense. The provision extends the subsidy from nine to 15 months and extends eligibility for those who lose their jobs through Feb. 28, 2010. Under current law, employees who lose their jobs after Dec. 31, 2010 are ineligible for the subsidy.

The IRS released the Employer's Tax Guide to Fringe Benefits (Publication 15-B) for 2010 which contains information for employers on the employment tax benefits of fringe benefits. The new version includes the 2010 limits for various benefits and includes new information on HSAs, qualified transportation benefits and minimum deductible and out-of-pocket maximum requirements for HSA-compatible HDHPs.

The DOL released an updated version of the Employment Law Guide to clarify many of the regulations affecting the workplace including an expansion of the Family and Medical Leave Act.

Although pending legislation could extend the ARRA COBRA Subsidy, under current rules anyone who experiences an involuntary termination but whose COBRA coverage does not take effect until after Dec. 31, 2009, is therefore ineligible for the subsidy. Eligibility is dependent both on the date of involuntary termination (prior to Dec. 31, 2009) and COBRA coverage eligibility date (prior to Jan. 1, 2009). Even though a person may have been terminated before Dec. 31, 2009, if their coverage extends to Dec. 31, 2009, they are not eligible for the subsidy. This is because their coverage cannot begin until Jan. 1, 2010, and thus making them ineligible.

The IRS announced the 2010 standard mileage rates for taxpayers to be reimbursed for the costs of operating an automobile for business, charitable, medical or moving expenses.
- 50 cents per mile for business miles driven
- 16.5 cents per mile driven for medical or moving purposes
- 14 cents per mile driven in service of charitable organizations
The 16.5 cents per mile mileage rate for medical care is a 7.5 cent decrease from the 2009 rate of 24 cents.
